You need to be aware that any physical activity involves some risk so we advise that individuals consult with their medical practitioners about undertaking these dance sessions as you remain responsible for your safety while participating.

Terms and Conditions

These are the terms and conditions related to participating in dance sessions from pre-recorded Video Packages or Live Online sessions with Sound Moves 55Plus Ltd.

To participate in dance sessions from pre-recorded Video Packages or Live Online sessions with Sound Moves 55Plus Ltd, you acknowledge and agree to the following by clicking the Check box below:

Safety

Personal Responsibility:
You understand that dance and physical activity involve movement that may carry a risk of injury. You agree to participate at a level that feels safe and comfortable for your body.
Health & Medical Considerations:
It is your responsibility to consult a medical professional before beginning any new exercise program, including the Sound Moves 55+ dance sessions, especially if you have any existing health conditions, mobility limitations, or concerns. Always stop immediately if you feel dizzy, short of breath, unwell, or experience pain. Rest and rejoin when you feel able.
Voluntary Participation:
Your participation is completely voluntary. You may modify movements, take breaks, or stop at any time. You are in charge of what you do in the dance sessions..
Supervision:
Because you are participating in dance from pre-recorded Video Packages or Live Online sessions, the instructor cannot see or monitor you at all times. You accept that the instructor is not responsible for any injuries that may occur due to limited visibility or technical issues.
Assumption of Risk:
By continuing with the session, you accept full responsibility for your own safety and wellbeing and release the instructor and Sound Moves 55Plus Ltd from liability for any injury or harm you may experience.
Hydration: Keep a water bottle within easy reach to keep hydrated throughout the dance session.

Emergency connection: Is there another person nearby who could help in the case of emergency? Keep your mobile phone on hand.

Safe Environment:
You agree to ensure your space is safe for movement – free of obstacles including rugs and other trip hazards, with appropriate flooring, footwear (if any), and enough space to avoid collision with objects or other persons and ensure you have adequate lighting. We are aware that most participants will have limited room to move so our Live Online and pre-recorded Video Package activities are designed to allow for this.

Use of Sound Moves 55+ Content

License to Use Content
All video content, including but not limited to text, graphics, user interfaces, visual interfaces, photographs, trademarks, logos, and artwork (collectively, “Content”), is owned or licensed by Sound Moves 55Plus Ltd and is protected by copyright and intellectual property laws.
- Access: Video Packages will be accessible online for purchasers for the duration publicised.
- Limited License:We grant you a limited, revocable, non-exclusive, non-transferable license to view and stream the Content for personal, non-commercial use only.
- Restrictions:You agree not to download, record, reproduce, distribute, modify, create derivative works of, publicly display, or sell any Content without the express written permission of Sound Moves 55Plus Ltd.
Acceptable Use and Conduct
You agree to use the platform only for lawful purposes. You are strictly prohibited from:
- Bypassing, disabling, or interfering with security-related features of the platform.
- Using any automated system (like “bots” or “scrapers”) to access the service.
- Uploading viruses, malicious code, or engaging in conduct that disrupts the servers or networks connected to the platform.
Account Termination
We reserve the right, at our sole discretion, to suspend or terminate your account and restrict your access to the platform for any violation of this Agreement or for any other lawful reason, without prior notice.
Disclaimers and Limitation of Liability
The platform and all video content are provided on an “as is” and “as available” basis. Sound Moves 55Plus Ltd makes no warranties that the service will be uninterrupted or error-free. To the maximum extent permitted by law, Sound Moves 55Plus Ltd shall not be liable for any indirect, incidental, or consequential damages arising from your use of the platform.
Refunds
We want you to be thrilled with your dance session! However, if you are unsatisfied with your video purchase, you may request a refund within 7 days of your original purchase date. Please note: Refunds aren’t always an automatic right. Refunds are not automatic if you:
- change your mind
- buy the wrong package
- buy the wrong level
Submit your request in writing to [email protected] giving your reason for requesting a refund. Refunds are limited to first-time purchases.
Governing Law
This Agreement shall be governed by and construed in accordance with the laws of Queensland, Australia, without regard to its conflict of law principles.
Privacy Settings
All settings on your computer/laptop/mobile device should be set to the appropriate privacy settings when taking part in online learning activities?
